Terms of Service

1. Service Description

ClaimStack is a software tool that analyzes insurance adjuster estimates to identify potentially missed, underpaid, or omitted line items. ClaimStack generates supplement recommendation reports based on this analysis.

2. Important Disclaimers

ClaimStack is a tool, not legal or insurance advice.

• ClaimStack provides analysis and recommendations. It does not guarantee that any specific supplement will be approved by an insurance carrier.
• The accuracy of our analysis depends on the quality and completeness of the uploaded estimate document.
• You are responsible for verifying that all recommended supplement items reflect actual conditions at the property.
• ClaimStack does not file claims or supplements on your behalf. You or your representative submit all documents to the carrier.
• We are not a public adjuster, licensed contractor, or legal firm. We provide software analysis only.

3. Acceptable Use

You agree to:

• Upload only estimates for claims where you have authorization to act (as the contractor of record, policyholder, or authorized representative)
• Not upload fraudulent, fabricated, or altered documents
• Use supplement recommendations honestly — only supplement for items that reflect actual damage and actual scope of work
• Comply with all applicable federal, state, and local laws regarding insurance claims

Insurance fraud is a felony. ClaimStack is designed to help contractors recover money they are legitimately owed. It is not a tool for inflating claims or submitting fraudulent supplements.

4. Subscription and Billing

• ClaimStack is billed monthly via credit card through Stripe
• Your subscription renews automatically each month until canceled
• You may cancel at any time by emailing cancel@getclaimstack.com — no cancellation fees
• The onboarding deposit is refundable per the terms of our guarantee
• No long-term contracts. Month-to-month only.

5. Our Guarantee

If ClaimStack does not help you identify at least $5,000 in additional supplement opportunities within your first 90 days, we will refund all fees paid — monthly subscription and onboarding deposit. To claim a refund, email guarantee@getclaimstack.com with your account details.

6. Limitation of Liability

ClaimStack's maximum liability is limited to the fees you have paid us in the 12 months preceding any claim. We are not liable for:

• Supplements that are denied by carriers
• Lost revenue or business opportunities
• Errors in analysis caused by incomplete or illegible uploaded documents
• Actions taken by insurance carriers, adjusters, or other third parties

7. Intellectual Property

Your uploaded documents remain your property. You grant ClaimStack a limited license to process your documents for the purpose of providing the analysis service. We do not claim ownership of your estimates, supplement letters, or claim data.

8. Account Termination

We reserve the right to terminate accounts that violate these terms, particularly regarding fraudulent use. You may terminate your account at any time.

9. Changes to Terms

We may update these terms. We will notify you of material changes via email. Continued use of the service after changes constitutes acceptance.
